Abstract

The mining sector remains the backbone of Zambia’s economy, contributing significantly to the country’s gross domestic product (GDP), foreign exchange earnings, and employment. Despite this centrality, Zambia’s legal and regulatory frameworks governing mining operations have repeatedly come under scrutiny for their inadequacy in ensuring environmental protection, penalizing violations effectively, and safeguarding the rights and interests of host communities. These gaps have not only compromised sustainable development but also heightened tensions between mining corporations, the state, and affected communities. A comparative analysis with countries like South Africa and Botswana whose mining frameworks has evolved with more robust environmental and social protection mechanisms offers critical lessons that can inform Zambia’s regulatory reforms.
