Assessing the Legal Challenges faced by Local Governments in Zambia: A Critical Analysis of the Impact of Decentralization and Development in Communities

Abstract

This study provided a critical analysis of the legal and institutional framework of decentralization in Zambia. It focused on the challenges that arise due to jurisdictional overlaps, legislative incoherence and administrative fragmentation. Drawing on doctrinal analysis and case-based inquiry; the study explores the gap that is between constitutional provisions, statutory instruments such as the Local Government Act, and The National Decentralization Policy. The study argued that decentralization in Zambia remains largely theoretical than fully implemented as it is hindered by weak enforcement mechanisms, broad ministerial control and limited legal capacities within local authorities. It also recommended several reforms, which include constitutional amendments to strengthen local autonomy, statutory revisions to clarify institutional mandates, and the creation of independent oversight bodies too, which will ensure compliance and resolve disputes. Ultimately, the purpose of this study was to promote a unified legal framework and stronger accountability mechanisms to enhance democratic governance and the practical realization of decentralized development in Zambia.
