    An Evaluation of the Effectiveness of Zambia’s Forfeiture of Proceeds of Crime Act in Combating Financial Crimes: Rationale, Implementation, Impact and Challenges

    This dissertation critically evaluated the effectiveness of Zambia’s Forfeiture of Proceeds of Crime through asset forfeiture mechanisms. It explored the rationale behind the Act, its legal and institutional framework, implementation procedures and its impact on combating financial crimes such as money laundering and corruption. This study looked at how Zambia handles asset forfeiture and identified a number of challenges, including unclear laws, high evidence standards, limited resources and poor coordination among enforcement agencies. By comparing the system used in Zambia to those used in other jurisdictions such as South Africa and the United States of America, this study discovered the need to improve our framework. While the Forfeiture of Proceeds of Crime Act marked a positive advancement in the fight against financial crime, the challenges in its implementation limit its effectiveness. To make the Act more effective, the study recommends updating the law, collaborations with other countries, investing in better technology, strengthening safeguards and building agent capacity.
